PRESENT: Deputy Mayor Basher, presiding; Trustees Butler, Hoyt, McGee, McGovern, and Zollo; Village Administrator McCabe; Village Treasurer Hart; Chief of Police Brown; Recreation Supervisor Arduino; Village Attorney Shumejda; and Village Clerk Booth
ABSENT: Mayor Fixell
The meeting began with the Pledge to the Flag.
PROCLAMATION – CELIA WILKINSON DAY
Whereas, Celia Wilkinson, a life-long Tarrytown resident, is celebrating her 95th birthday; and Whereas, Celia Wilkinson has been very involved in the Neighborhood House and has served on the board of the Neighborhood House for many years; and
Whereas, Celia Wilkinson is also a member of the Immaculate Conception Church and has held numerous volunteer positions at the Church over the years; and
Whereas, Celia Wilkinson has also given her time to the Village of Tarrytown assisting on Election Day for many years; and Whereas, Celia Wilkinson, having resided on Baylis Court for most of her life, has many fond memories of Tarrytown. Now therefore be it resolved that I, Drew Fixell, Mayor of Tarrytown, New York, in recognition of a lifetime of devotion to our community, thank and commend Celia Wilkinson and hereby declare July 17, 2007 Celia Wilkinson Day In the Village of Tarrytown.
REPORTS
Trustee Butler reported on the following:
- The Planning Board has approved an amendment to the approved site plan for C-Town Supermarket to allow for mezzanine space and outdoor deck.
- The Planning Board approved the Findings Statement for the Legends at Wilson Park.
- The Planning Board accepted the Scoping Document for Jardim Estates East but allowed for the submission of written public input until July 11, 2007.
- The Planning Board is reviewing site plans for 6 proposed new single-family homes in the Village: Jardim Estates, Intersection of Beech Lane and Wilson Park Drive and Intersection of Fairview Avenue and Altamont Avenue.
- The Planning Board is reviewing plans for a proposed subdivsion at 116 Altamont Avenue.
Trustee Butler also reported the following concerns to the Board that residents have brought to his attention: 1) The community bulletin board needs an upgrade; 2) Glenville Fire District with respect to Fire Department support and revenue sharing with new hotels that have been added to that district; and 3) Downtown parking is still seriously being looked at by Trustee Zollo and Village Administrator McCabe.
Deputy Mayor Basher stated that there will be a grand opening of our new Neperan Road Park at 7:00 p.m. This will take place along with the Third Friday and he hopes the residents will come out and share in the joy of the opening of our new park in Tarrytown.
PUBLIC HEARING REGARDING A PROPOSED LOCAL LAW TO REGULATE SEWAGE DISCHARGE FROM BOATS DOCKED IN TARRYTOWN (Adopted)
Trustee Zollo moved, seconded by Trustee Butler, and unanimously carried that the public hearing be opened.
PLEASE TAKE NOTICE that the Board of Trustees of the Village of Tarrytown will hold a public hearing on the 16 day of July, 2007, at 8 PM, in the Municipal Building,
21 Wildey Street, Tarrytown, New York 10591, to hear, discuss and to act upon a proposed amendment to the Code of the Village of Tarrytown by amending §93-3 entitled "Discharges from boats" of Chapter 93: Boats and Boating of the Tarrytown Code. A summary of the legislation is available at Village Hall. The complete text of this legislation follows:
A LOCAL LAW to amend the Code of the Village of Tarrytown by amending§93-3 entitled "Discharges from boats" of Chapter 93: Boats and Boating of the Tarrytown Code.
SECTION 1. LEGISLATIVE INTENT AND FINDINGS OF FACT.
A. Findings of Fact.
The Board of Trustees of the Village of Tarrytown has determined that there is a need to amend §93-3 entitled "Discharges from boats" of Chapter 93: Boats and Boating of the Tarrytown Code in order insure that boats docked at any marina or boat club in the Village not discharge waste products into the Hudson River given that the Hudson River was declared a no discharge zone in 2003 and the Village of Tarrytown was declared a no discharge zone in 1992.
B. Legislative Intent.
It is the intention of the Board of Trustees of the Village of Tarrytown to amend §93-3 entitled "Discharges from boats" of Chapter 93: Boats and Boating of the Tarrytown Code in order to insure that boats docked at any marina or boat club in the Village not discharge waste products into the Hudson River by mandating the use of dye tablets in boats which are equipped with toilet facilities while docked at a boat club or marina.

SECTION 2. Amendment to §93-3 entitled "Discharges from boats" of Chapter 93: Boats and Boating of the Tarrytown Code.
§ 93-3. Discharges from boats.
A. No garbage, oil, sludge, paper, refuse, debris, sewage or waste material of any kind shall be thrown, deposited, discharged or permitted to fall from any boat into any part of the village waterways.
B. The operator of any boat club or marina that provides docking for more than 20 boats shall be required to make known to all vessel owners or operators that have boats which are [i] equipped with marine toilet facilities and [ii] domicile or rent boat slips from such boat club or marina on a seasonal or temporary basis, that a dye tablet must be placed in the toilet and holding tank of said boats. It shall be the responsibility of the aforementioned boat club or marina to provide the requisite dye tablets to the vessel owner or operator and, it shall be the responsibility of the vessel owner or operator to place the dye tablet in the toilet and holding tank of said boat upon either the arrival or launching of said vessel at the boat club or marina. The type of dye tablet to be used under these
provisions shall be specified by the Harbor Master on an annual basis.

SECTION 3. EFFECTIVE DATE
This local law shall take effect immediately, as provided by law.
All interested parties are invited to attend and be heard. Access to the meeting room is available to the elderly and the handicapped. Signing is available for the hearing-
impaired; a request must be made to the Village Clerk at least five days in advance of the meeting.

Trustee Hoyt moved, seconded by Trustee Zollo, and unanimously carried that the public hearing be closed.
Trustee Zollo moved, seconded by Trustee Butler, and unanimously carried that the following local law be adopted: Approved: 6-0
DISCHARGES FROM BOATS AMENDMENT TO VILLAGE CODE
NEGATIVE DECLARATION
WHEREAS, the Proposed Action is an Unlisted action pursuant to the State Environmental Quality Review Law, and
WHEREAS, an Environmental Assessment Form [EAF] was filed and,
WHEREAS, a notice of public hearing was published in the Journal News on July 5, 2007, and
WHEREAS, public hearing was held for the proposed action on July 16, 2007, and
WHEREAS, the Board of Trustees of the Village of Tarrytown is the only agency which has approval authority over the Proposed Action, and is therefore the Lead Agency for the Proposed Action
NOW, THEREFORE, BE IT RESOLVED AS FOLLOWS:
1. In accordance with Article 8 of the State Environmental Conservation Law and 6NYCRR Part 617, including without limitations the criteria set forth in 6 NYCRR Part 617.7(c) and based upon review of the Environmental Assessment Form and all other materials that were prepared for the Proposed Action, the Village Board of Trustees hereby determines that Proposed Action will not have a significant adverse impact on the environment, and hereby adopts a Negative Declaration.
NOW THEREFORE BE IT FURTHER RESOLVED that the Board of Trustees of the Village of Tarrytown hereby adopts Local Law No. 7 of 2007.

Laura Copeland, Fairview Avenue, stated that she and Fred Ellman wrote to the Board of Trustees requesting the Board to impose a minimum of a six-month building moratorium on unapproved lots in order to use that time to review and implement the Village’s recently passed Comprehensive Plan. She also had a petition with 3 pages of signatures. Deputy Mayor Basher stated that the Board chose not to approve a temporary moratorium, but instead to hold public hearings on amending certain zoning laws that were recommended by the Planning and Zoning Committee.
AUTHORIZATION TO ENTER INTO AN AGREEMENT WITH WESTCHESTER COUNTY REGARDING THE POLICE ACADEMY INSTRUCTORS PROGRAM
Trustee McGovern moved, seconded by Trustee Butler, and unanimously carried that the following be approved: Approved: 6-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby authorizes the Village Administrator to execute an agreement between the Village and Westchester County regarding the Police Academy Instructors Program in order to facilitate exchanging Tarrytown police officers as instructors for the free training of Tarrytown police officers.
RESOLUTION – PROVISIONAL APPOINTMENT OF RECREATION ASSISTANT/ INTERMEDIATE CLERK – DIANE SPIES
Trustee Hoyt moved, seconded by Trustee McGee, and unanimously carried that the following be approved: Approved: 6-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the appointment of Diane Spies as Recreation Assistant/Intermediate Clerk at an annual salary of $30,000 effective July 17, 2007. Said appointment is provisional and pursuant to the approval of the Westchester County Department Human Resources and is subject to all applicable civil service rules and regulations.
AUTHORIZATION TO HIRE A GRANT WRITER
Trustee Butler moved and seconded by Trustee Zollo, and unanimously carried that the following be approved: Approved: 6-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby authorizes a contract between the Village and Martin Schneider of Piermont, NY, for grant writing services in the amount up to $75.00/hour subject to a successful reference check and for the contract to include a mutual 30-day escape clause.
APPROVAL OF THE MINUTES OF THE REGULAR MEETING OF THE BOARD OF TRUSTEES HELD ON JUNE 18, 2007
Trustee McGee moved, seconded by Trustee Zollo, and unanimously carried that the following be approved: Approved: 6-0
BE IT RESOLVED that the Board of Trustees of the Village of Tarrytown hereby approves the minutes of the regular board meeting held on June 18, 2007 as submitted by the Village Clerk.
APPROVAL OF AUDITED VOUCHERS #2
Trustee Butler moved, seconded by Trustee Zollo, and unanimously carried that the following resolution be approved:

following amounts as presented:

The Board was polled all voting “aye” with the exception of Trustee McGee who abstained from Voucher Numbers 000283, 000327, and 000328, 00329, 000356, 000357, and 000521 and Trustee Hoyt who abstained from Voucher Number 000265, 000266, 000225, 000226, 000287, 000383, and 000459. Motion carried 6-0.

Trustee Hoyt moved, seconded by Trustee Zollo, and unanimously carried, that the meeting be adjourned at 8:30 p.m.
